Senate Bill 1
was signed into
law by Governor
Blunt, to become
effective August
28, 2005. That
workers'
compensation
bill was
anti-family and
anti-worker, as
none of its
changes
benefited those
who suffer
job-related
injuries and
illnesses. This
legislation
targets workers
and their
families with
outrageous
penalties,
hurdles and
obstacles to
obtaining
medical care and
income while
unable to work.
The Governor and
his followers
chose this path,
instead of
changing the law
to better
protect
Missouri's
families and
workforce.
Our Firm, as
lead counsel,
along with other
leading trial
attorneys
throughout the
state, is
spearheading a
constitutional
challenge to
Senate Bill 1,
which is
currently
pending before
the Missouri
Supreme Court.
The plaintiffs
in the challenge
are 72 unions,
associations,
and federations,
whose members
are negatively
affected by the
2005 changes.
The materials
below consist of
the original
petition, the
list of
plaintiffs, and
the multiple
briefs that have
thus far been
filed. They
include briefs
by the
plaintiffs/appellants
and friends of
the court
("amicus"). Oral
argument will
likely take
place in the
Fall of 2007.
